1. About these terms

Welcome to My Brain Books. This website and store is operated by My Brain Books Pty Ltd (ABN 54 690 610 890) ("My Brain Books", "we", "us", or "our"). The terms "we", "us", and "our" refer to My Brain Books. My Brain Books is powered by Shopify, which enables us to provide our store, website, content, products, and services (the "Services") to you.

These Terms of Service, together with any policies referenced here (our "Terms"), describe your rights and responsibilities when you use the Services. They include important information such as warranty disclaimers and limitations of liability, so please read them carefully.

By visiting, interacting with, or purchasing from our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access the Services.

2. Access and your account

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or country of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use the Services.

To use the Services, you may be asked to provide certain information, such as your email address and billing, payment, and shipping details. You represent that all information you provide is correct, current, and complete, and that you have the rights necessary to provide it. You are responsible for keeping your account credentials secure and for all activity under your account, and you may not transfer, sell, or assign your account to anyone else.

3. Our products

My Brain Books sells children's mental-health picture books, card decks, bundles, workbooks, posters, and related printed and digital learning resources.

Our resources are designed to support children's emotional wellbeing and learning. They are not a substitute for professional medical, psychological, or educational advice, diagnosis, or treatment. If you have concerns about a child's health or wellbeing, please consult a qualified professional (see clause 12).

4. Products, pricing, and availability

• Prices are shown on the site and are subject to change without notice. The price charged will be the price in effect when your order is placed, as shown in your order confirmation email.
• Our home currency is Australian Dollars (AUD); the currency displayed depends on your selected country/region. Unless stated otherwise, posted prices do not include taxes, shipping, handling, or customs/import charges.
• We make every effort to display our products and their colours accurately, but we cannot guarantee that your device's display will be accurate, and we do not warrant that a product's appearance or quality will match your expectations exactly.
• All products are subject to availability. We reserve the right to limit quantities, to discontinue any product, and to refuse or limit orders to any person, region, or jurisdiction at our discretion.

5. Orders and acceptance

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason, and your order is not accepted until we confirm acceptance. We must receive and process your payment before an order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. If we decline, change, or cancel an order, we'll try to notify you using the email, billing address, or phone number provided, and we'll refund any payment taken.

Your purchases are for your own personal or household use and not for commercial resale or export.

6. Payment and billing

We accept the payment methods shown at checkout, which may include Visa, Mastercard, American Express, Apple Pay, Google Pay, PayPal, Shop Pay, and others. Payment is processed securely through Shopify and its payment partners. You represent that any payment information you provide is true and correct, that you are authorised to use the payment method, and that you will pay all charges incurred, including shipping and applicable taxes. You agree to keep your payment and account details current so we can complete your transactions and contact you if needed.

7. Shipping and delivery

We ship to Australia, New Zealand, Canada, the United States, the United Kingdom, the EU, and Singapore.

• Australia, New Zealand, Canada, UK, and EU: orders ship from our international distribution centre; please allow 5-12 business days for delivery.
• United States: orders ship from our distribution centre in Salt Lake City; delivery typically takes 4-7 days.
• You'll receive an email with tracking once your order is fulfilled. Tracking usually becomes active once your package reaches your destination country and is processed by your local postal service.
• Free shipping applies to orders over $75 AUD (or the local currency equivalent). As a small business, we subsidise shipping to keep our books affordable; the charge at checkout covers only part of the actual postage cost.

Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control. Once we transfer products to the carrier, risk of loss passes to you, subject to your rights under applicable consumer law.

8. Customs, duties, and taxes

International orders may be subject to import duties, taxes, and customs fees charged by the destination country. These are the responsibility of the customer and are not included in our prices or shipping charges. Please check with your local customs office if you're unsure.

9. Returns and refunds

Returns and refunds are governed by our Refund & Returns Policy, which forms part of these Terms. In summary:

• Change-of-mind returns: contact us within 14 days of receiving your order and return the item within a further 14 days; items must be unused and in brand-new condition; return postage is at the customer's expense.
• Faulty, damaged, or incorrect items: contact us as soon as possible; we cover return postage and will arrange a replacement or refund.
• Refunds are processed to your original payment method within 10 business days of us receiving the returned item.
• Digital downloads are non-refundable once accessed.

Nothing in these Terms limits your rights under applicable consumer law (see clause 20).

10. Digital products and licence

Some of our products are digital (for example, printable PDF worksheets and posters). When you purchase a digital product, we grant you a limited, non-exclusive, non-transferable licence to download and use it for personal, family, or single-classroom use.

Unless we've agreed otherwise in writing, you may not resell, redistribute, sub-licence, or share the files; upload them to any public or shared file-sharing service; or use them for commercial purposes. Digital products are delivered electronically and are non-refundable once accessed or downloaded (see our Refund & Returns Policy).

11. Intellectual property

All content in the Services, including trademarks, text, illustrations, book and card artwork, designs, logos, graphics, reviews, video, and audio, and the selection and arrangement of that content, is owned by My Brain Books, its affiliates, or its licensors and is protected by Australian and foreign copyright, trademark, and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of our content without our prior written consent, except as expressly allowed by the digital-product licence in clause 10. The My Brain Books name, logo, and product names are our trademarks and may not be used without our permission. Shopify's name and logo are trademarks of Shopify. All other trademarks are the property of their respective owners.

12. Educational and wellbeing disclaimer

Our resources are created with care, drawing on psychology, teaching experience, and lived experience. However, the information in our books, cards, and digital products is provided for general educational and wellbeing purposes only. It is not professional advice and should not be relied upon as a substitute for advice from a qualified health, psychological, or educational professional. Any reliance you place on our content is at your own risk.

13. Optional third-party tools

You may be given access to third-party tools through the Services that we neither monitor nor control. You acknowledge that we provide access to such tools "as is" and "as available" without warranties or endorsement, and we have no liability arising from your use of them. Any use of optional third-party tools is entirely at your own risk, and you should review the relevant provider's terms. New tools or features we add in future are also part of the Services and subject to these Terms.

14. Third-party links

The Services may contain links to websites or content operated by third parties. We are not responsible for examining or evaluating their content or accuracy, and we are not liable for any harm arising from your access to them or from any purchase you make on a third-party site. Please review a third party's own policies before transacting with them, and direct any complaints about their products or services to that third party.

15. User comments and feedback

If you send us comments, ideas, feedback, reviews, or other submissions (for example, through our contact form or product reviews), you grant us a worldwide, royalty-free, sub-licensable licence to use, reproduce, modify, publish, and display that content for any purpose, including operating and promoting the Services. You represent that you own or have the rights to your submissions, that they don't infringe anyone's rights, and that they are not unlawful, misleading, offensive, or harmful. We are under no obligation to keep submissions confidential, to pay for them, or to respond, and we may (but are not obliged to) monitor, edit, or remove content at our discretion.

16. Prohibited uses

You may use the Services for lawful purposes only. You agree not to use the Services: for any unlawful or malicious purpose; to violate any laws or regulations; to infringe our or others' intellectual property rights; to harass, abuse, defame, or harm any person; to transmit false or misleading information or spam; to impersonate any person or entity; to upload viruses or malicious code; to collect or track others' personal information; to scrape or harvest data; or to interfere with, bypass, or circumvent the security features of the Services. We may suspend, disable, or terminate your access if we determine you have breached these Terms.

17. Automated access and AI agents

If you use, enable, or deploy any software or service that takes autonomous or semi-autonomous action on your behalf (an "Agent") to access or interact with the Services, that Agent must identify itself as an Agent in its requests (including its user-agent string), must not conceal that it is automated or mimic human behaviour to evade detection, must answer truthfully if asked whether it is a human or a computer, and must not circumvent CAPTCHAs or other measures intended to control automated access. We may limit or block Agent access by technical or other means at our discretion.

18. Relationship with Shopify

My Brain Books is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with My Brain Books. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and My Brain Books, including any injury, damage, or loss resulting from products or services purchased. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with My Brain Books.

19. Privacy

All personal information we collect through the Services is handled in accordance with our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes personal information about your use of the Services in order to provide and improve them, and information you submit may be transmitted to and shared with Shopify and other service providers that may be located outside your country of residence. By using the Services, you acknowledge that you have read our Privacy Policy.

20. Disclaimer of warranties

To the maximum extent permitted by law, the Services and all products offered through them are provided on an "as is" and "as available" basis, without warranties or conditions of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that your use of the Services will be uninterrupted, secure, or error-free.

However, nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other consumer protection laws that cannot lawfully be excluded. Where a guarantee cannot be excluded but we are permitted to limit our liability, our liability is limited (at our option) to replacing or repairing the goods, supplying equivalent goods, or refunding the price.

21. Limitation of liability

To the fullest extent permitted by law, My Brain Books and its directors, officers, employees, affiliates, agents, and suppliers (and those of Shopify) will not be liable for any indirect, incidental, special, or consequential loss, including lost profits, lost data, or replacement costs, arising from your use of the Services or any product purchased. Our total liability for any claim will not exceed the amount you paid for the relevant product. This clause does not exclude liability that cannot be excluded under applicable consumer law (see clause 20).

22. Indemnity

You agree to indemnify and hold harmless My Brain Books, Shopify, and our respective affiliates, directors, employees, agents, and suppliers from any claim or demand, including reasonable legal costs, arising out of your breach of these Terms, your violation of any law, or your infringement of the rights of a third party.

23. Termination

We may terminate these Terms or your access to the Services (or any part of them) at our discretion at any time without notice, and you will remain liable for all amounts due up to the date of termination. The clauses that by their nature should survive termination will continue to apply, including Intellectual property, User comments and feedback, Disclaimer of warranties, Limitation of liability, Indemnity, Governing law, and Privacy.

24. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity of the remaining provisions.

25. Waiver and entire agreement

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with any policies posted on our site, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements.

26. Assignment

You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent, and any such attempt is void. We may assign or transfer these Terms and our rights and obligations without notice or consent.

27. Errors, inaccuracies, and omissions

Occasionally there may be information in the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any such errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

28. Changes to these terms

We may update these Terms from time to time. The most current version will always be posted on this page with the "Last updated" date above. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.

29. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you agree to submit to the non-exclusive jurisdiction of the courts of that state. This does not affect any mandatory consumer protection rights available to you in your country of residence.
